Jakarta - Asosiasi Pengusaha Indonesia (Apindo) mendukung upaya judicial review terhadap Peraturan Menteri (Permen) Tenaga Kerja soal outsourcing. Gugatan itu bakal dilakukan oleh perusahaan-perusahaan outsourcing di bawah Apindo.

"Kalau soal lima item kita nggak setuju, tentu para asosiasi (outsourcing) akan ke Mahkamah Konstitusi (MK) memastikan apakah ini bertentangan dengan UU No. 13 Tahun 2003 tentang ketenagakerjaan," kata Ketua Umum Apindo Sofjan Wanandi kepada detikFinance, Senin (19/11/12)

Sofjan mengaku belum mendapat Permen tersebut, sehingga belum tahu persis seperti apa isinya. Namun dari penuturan Muhaimin di media massa, Permen tersebut membatasi outsourcing hanya untuk lima pekerjaan yaitu jasa pembersihan (cleaning service), keamanan, transportasi, katering, dan Jasa Migas Pertambangan.

"Kalau itu isinya pasti akan di-judicial review, asosiasi lain, kita akan dukung, bukan dari kita karena kita bukan perusahaan outsourcing. Yang lima itu, memang dalam UU yang boleh non core antaralain yang lima itu, tapikan setiap perusahaan intinya beda-beda," kata Sofjan.

Seperti diketahui Menteri Tenaga Kerja dan Transmigrasi Muhaimin Iskandar akhirnya menandatangani Peraturan Menteri Tenaga Kerja dan Transmigrasi (Permenakertrans) mengenai outsourcing pada Kamis pekan lalu.

Kepala Humas Kemenakertrans Suhartono menjelaskan, dalam aturan baru itu pekerjaan outsourcing ditutup kecuali lima jenis pekerjaan, yaitu jasa pembersihan (cleaning service), keamanan, transportasi, katering, dan Jasa Migas Pertambangan.

Untuk mempermudah, Muhaimin meminta istilah outsourcing tidak lagi digunakan. Lebih baik memakai istilah dua jenis pola hubungan kerja yaitu pola hubungan kerja dengan PPJP atau (Perusahaan Pengerah Jasa Pekerja) yang hanya meliputi 5 jenis pekerjaan tadi.

Sedangkan pola hubungan kerja kedua adalah pemborongan yang menggunakan sub kontrak perusahaan atau Perjanjian Kerja Waktu Tertentu (PKWT). Menurut Suhartono dengan ditandatanganinya Permenakertrans soal outsourcing tersebut, maka pengaturan pelaksanaan outsourcing harus segera dilaksanakan sesuai dengan amanat perundang-undangan.

VIVAnews – Menteri Tenaga Kerja dan Transmigrasi, Muhaimin Iskandar, telah menandatangani peraturan baru mengenai pelaksanaan pekerjaan alih daya atau outsourcing.

Peraturan ini menegaskan, outsourcing hanya boleh dilakukan untuk lima jenis pekerjaan, yaitu jasa pembersihan (cleaning service), kemanan, transportasi, katering, dan migas pertambangan. Di luar itu, penerapan outsourcing dilarang.

Namun Kemenakertrans telah menyediakan alternatif bagi pengusaha di luar sistem outsourcing, yaitu model borongan yang menggunakan subkontrak perusahaan atau Perjanjian Kerja Waktu Tertentu (PKWT). Lantas apa beda outsourcing dengan model borongan itu?

"Kami beri alternatif model borongan karena pengusaha khawatir. Model borongan ini misalnya ada order dari Nike pusat di Amerika Serikat untuk memproduksi sepatu di Indonesia dalam waktu tiga bulan, maka kontraknya bisa langsung ke perusahaan sepatu di sini," kata Muhaimin kepada VIVAnews, Minggu 18 November 2012.

"Sementara borongan dengan model PKWT, misalnya perusahaan media menyewa pegawai administrasi, itu tidak boleh melalui perantara, tapi harus langsung mereka yang mengontrak. Misalnya mereka mengontrak seseorang selama setahun, setelah setahun maka kontrak bisa diperpanjang lagi setahun, baru kemudian harus menjadi pegawai tetap. Jadi ada perpanjangan masa kontrak dua kali," papar Muhaimin.

Model PKWT ini, ujar Muhaimin, lebih menjamin masa depan pekerja karena pekerja tidak terlalu lama diombang-ambing ketidakpastian tentang nasib dan status mereka di suatu perusahaan. "Kalau outsourcing kan tidak begitu. Pekerja dikontrak setahun, lalu kontraknya setahun habis langsung bisa dikontrak lagi setahun, begitu terus sampai sepuluh tahun," kata dia.

Model outsourcing semacam itu, tegas Muhaimin, memang melanggar filosofi Undang-Undang Ketenagakerjaan. "Nasib pekerja bagaimana kalau seperti itu?" ujar dia. Untuk peralihan dari outsourcing ke model borongan ini, pemerintah menyediakan masa transisi setahun.

Muhaimin berharap semua pihak bisa memahami alternatif model borongan ini. "Kita berdebat soal ini (outsourcing) sudah dua tahun lebih, bahkan hampir tiga tahun. Sekarang tentu harus ada kepastian hukum. Apalagi pekerja dan pengusaha sudah kami dudukkan bersama," kata Ketua Umum PKB itu. (eh)
